In Europe, the story has been all about the dreaded PIG — Portugal, Ireland and Greece. And then in recent months Italy and Spain came under fire, which required the buyer of last resort — the European Central Bank — to quell the downward spiral in those government bond markets.

But this week, one of the two core engines of Europe, which is also one of the key orchestrators of managing the euro-zone crisis, is in the crosshairs: France.

In advanced economies, banks often have sizeable exposures to their own domestic government debt. Therefore, when sovereign debt gets downgraded, bank creditworthiness tends to be downgraded, too.

The chart below shows the credit default swaps of France (orange), the U.S. (red) and a major French bank (black).

You can see in this chart the markets are pricing in nearly twice as much risk of a French government default than they were in early July. The difference between the orange line (France) and the red line (the U.S.) indicates that market participants think that France is three times more likely to default than the U.S.

With that, it’s no surprise that French banks also came under attack this week …

And the vicious cycle is set into motion — where bad banks drag down sovereigns and bad sovereigns drag down banks.

Defaults Ahead

As we’re seeing, there is no painless way to avoid the economic shocks associated with a badly overleveraged world.

The general consensus has been that inflation would be the favored solution. That’s precisely why gold traded north of $1,800 this week.

But despite central bankers’ best efforts, inflation isn’t in the cards any time soon. Record low yields in U.S. Treasuries confirm that.

And austerity doesn’t seem to be working either. Take Greece for example. Greece has been operating under the austere requirements of the EU and IMF for more than a year. Yet things haven’t gotten better for Greece; they’ve gotten worse — across the board as shown below.

To sum up the above table: Since adopting tough austerity measures, the Greek economic activity is contracting more aggressively. Its debt burden is growing, led by continued worsening deficits — precisely what the austerity plans are crafted to reduce.

The risk premium in Greek government bonds is higher, government revenue is lower, spending is higher and Greece needs even more money to stay afloat.

Put simply: Austerity is not working!

One thing austerity is doing, though, is its killing global growth.

And that’s not good for the outlook of commodities. And historically, a common trigger for global sovereign debt defaults happens to be … falling commodity prices.

As I’ve said many times here in our newsletters, in a world still working through a historic global financial crisis, we should expect downgrades and we should expect defaults. For your investments, it’s about preservation of capital.

The Bad:

The president of the offshore New Zealand program terminated our agreement unilaterally in late June. I introduced dozens of clients, prospective clients and referral partners.

He threatened to come to my home and shoot me. My wife and children overheard and became frightened. I reported the matter to the Antioch CA P.D. at their urging fearing for their safety and mine. I have the incident report number and badge number of the officer.

Isn’t that sad?

This is a man whom I have known for almost five years. We socialized. I have shared meals with he and his wife. He called me his friend, buddy, pal and other endearing terms to dozens on five live recorded conference calls. Now he stiffs me for $100,000 +/- in commissions and steals my clients and referral partners.

Is this the type of person you should trust with your money?

I received a call Friday from Jennifer Pxxx who reported two clients that lost $1m and $10m in similar programs to what you have stated. One was in Switzerland. The client and his attorney traveled to Switzerland. He was paid $1.2m total in six months. When he went back to Switzerland the office was vacant and the “traders” had disappeared along with his $10m.

 

All “real trades” are cash trades. Money moves.

The Ugly:

The president of the offshore New Zealand program has been libeling me and slandering me and the program manager of the Gold Program. Here is an email that I sent him on Thursday July 21, 2011:


I took my instruction from you, Chris. I have the notes from everything that you said. I also have the five live recordings where you said you would not allow circumvention not once but multiple times on multiple calls. 


Why would you say one thing and turn around and do something different?


I have clients, prospective clients, and referral partners that have reported that you are libeling and slandering me. 


You never had a kind word for Alicia, Irina, Greg, Francisco, David R, Robert L, Chris K, Greg P, Judy T, Bill S, Dwain W, and dozens of others. I have the notes and emails. 


Word got back to Greg that you are bad mouthing me and the gold program. We have never bad mouthed you. You claim that you’ve been in business 23 years in New Zealand but there is no record of that. You are claiming that the gold program isn’t real yet we have clients that have been paid every month. 10% is 10%. We don’t charge fees and commissions to the client. We make money on the transactions and arbitrage. The programs (yours and the gold program) are completely different. 


Please stop libeling, slandering, bad mouthing, bullying, and lying. 


I was your advocate. I was your evangelist. I was your valued and trusted partner. Proof of that is clear in reading what Robert and Alicia are sending out. It’s nearly word for word what I wrote for months in emails, newsletters and web postings and what I stated on calls.


You have no business bad mouthing anyone. There is no cause for you to libel or slander me or Greg for your benefit. Stop “Trash Talking.”


A trusted adviser is one who is perceived as a “high integrity expert” who is willing and able to help people. Establishing and maintaining that integrity does not involve pointing fingers or launching attacks. Although you think that you’re winning points with clients, prospective clients, and referral partners you’re ultimately undermining yourself and your success by cutting down your own company.


Be professional but resist the temptation to join in throwing rocks. Don’t bash your competitors as it sends negative vibes making you look petty . It causes clients, prospective clients, and referral partners to question whether you are trying to compensate for something.


Know your competition but don’t spend time trashing them. Chances are you will be inaccurate or will upset the clients, prospective clients, and referral partners who end up coming back and reporting to me and Greg. Focus on what the customer needs and and show how you can deliver it to him or her. Talk about your unique advantage in the market, not your competitor’s problems.


If it’s not honest, don’t do it.


SW, SW, SW, SW: Some Will, Some Won’t, So What, Someone is Waiting.


You know who your competition is. We have no doubt that you perform. The bank world is volatile. We can live with that. There is no reason for you to pull this childish “sand box shxx.” We are not saying anything negative about you. If we’re not a good fit you may be a good fit. You’re performing. We’re performing.


If you are good, people will know it. There is no need for you to belittle others. Our track record on the gold program is spotless. Our yields to clients are higher than yours. We’re doing better for our clients than you are for yours. There’s room for both programs and many more programs like them. 


This is not a competition. We have similar client pools. We’re not really competing. We don’t have a sub-account. We have a pure trade. We don’t charge management fees. We don’t deduct commissions. We don’t charge early withdrawal penalties. 


Clients need to trust both you and us to meet our contractual obligations. There is nothing “imaginary” about our program. 


Pay me the balance of what you owe me and pay it today.

Leases are junk deals unless they are operating mines. I have known Dan for 2 years and I am not interested in working with him.  He has shopped this deal all over the Internet. This is a waste of time Joe.

 

Joe these non-operating BLM leases have all type EPA violations. You can not put them into trade the FEDS will not allow any violations and liens against an asset to go into trade. They own the lease rights from the BLM and that is all. It would be different if they owned the land.  Think about it… why does the asset holder not go to his bank and get a loan? The banks will not loan against them for the same reasons. Private investors will not for the same reasons. This is a shopping frenzy to hope it will stick somewhere. He sent me some junk about 3 weeks ago and I told him to not bother me anymore with anything.

 

Dan has brought me many deals and all were junk and all had been shopped relentlessly.

The Bad:

The president of the offshore New Zealand program terminated our agreement unilaterally last month after I introduced dozens of clients, prospective clients and referral partners.

He threatened to come to my home and shoot me. My wife and children overheard and became frightened. I reported the matter to the Antioch CA P.D. at their urging fearing for their safety and mine. I have the incident report number and badge number of the officer.

Isn’t that sad?

This is a man whom I have known for almost five years. We socialized. I have shared meals with he and his wife. He called me his friend, buddy, pal and other endearing terms to dozens on five live recorded conference calls. Now he stiffs me for $100,000 +/- in commissions and steals my clients and referral partners.

Is this the type of person you should trust with your money?

The Ugly:

The president of the offshore New Zealand program has been libeling me and slandering me and the program manager of the Gold Program. Here is an email that I sent him on Thursday July 21, 2011:

I took my instruction from you, Chris. I have the notes from everything that you said. I also have the five live recordings where you said you would not allow circumvention not once but multiple times on multiple calls. 

 

Why would you say one thing and turn around and do something different?

 

I have clients, prospective clients, and referral partners that have reported that you are libeling and slandering me. 

 

You never had a kind word for Alicia, Irina, Greg, Francisco, David Roth, Robert Lewis, Chris King, Greg Parry, Judy Taylor, Bill Smith, Dwain Wiley, and dozens of others. I have the notes and emails. 

 

Word got back to Greg that you are bad mouthing me and the gold program. We have never bad mouthed you. You claim that you’ve been in business 23 years in New Zealand but there is no record of that. You are claiming that the gold program isn’t real yet we have clients that have been paid every month. 10% is 10%. We don’t charge fees and commissions to the client. We make money on the transactions and arbitrage. The programs (yours and the gold program) are completely different. 

 

Please stop libeling, slandering, bad mouthing, bullying, and lying. 

 

I was your advocate. I was your evangelist. I was your valued and trusted partner. Proof of that is clear in reading what Robert and Alicia are sending out. It’s nearly word for word what I wrote for months in emails, newsletters and web postings and what I stated on calls.

 

You have no business bad mouthing anyone. There is no cause for you to libel or slander me or Greg for your benefit. Stop “Trash Talking.”

 

A trusted adviser is one who is perceived as a “high integrity expert” who is willing and able to help people. Establishing and maintaining that integrity does not involve pointing fingers or launching attacks. Although you think that you’re winning points with clients, prospective clients, and referral partners you’re ultimately undermining yourself and your success by cutting down your own company.

 

Be professional but resist the temptation to join in throwing rocks. Don’t bash your competitors as it sends negative vibes making you look petty . It causes clients, prospective clients, and referral partners to question whether you are trying to compensate for something.

 

Know your competition but don’t spend time trashing them. Chances are you will be inaccurate or will upset the clients, prospective clients, and referral partners who end up coming back and reporting to me and Greg. Focus on what the customer needs and and show how you can deliver it to him or her. Talk about your unique advantage in the market, not your competitor’s problems.

 

If it’s not honest, don’t do it.

 

SW, SW, SW, SW: Some Will, Some Won’t, So What, Someone is Waiting.

 

You know who your competition is. We have no doubt that you perform. The bank world is volatile. We can live with that. There is no reason for you to pull this childish “sand box shxx.” We are not saying anything negative about you. If we’re not a good fit you may be a good fit. You’re performing. We’re performing.

 

If you are good, people will know it. There is no need for you to belittle others. Our track record on the gold program is spotless. Our yields to clients are higher than yours. We’re doing better for our clients than you are for yours. There’s room for both programs and many more programs like them. 

 

This is not a competition. We have similar client pools. We’re not really competing. We don’t have a sub-account. We have a pure trade. We don’t charge management fees. We don’t deduct commissions. We don’t charge early withdrawal penalties. 

 

Clients need to trust both you and us to meet our contractual obligations. There is nothing “imaginary” about our program. 

 

Pay me the balance of what you owe me and pay it today.

What you need to know about FDIC and unlimited coverage.

IOLTA Accounts Have Unlimited Insurance until December 31, 2012

IOLTA accounts will be fully guaranteed by FDIC insurance, without limit at all banks starting on January 1, 2011.

On December 29, 2010, President Obama signed HR 6398 which corrected an oversight in the Dodd-Frank Wall Street Reform and Consumer Protection Act (“Dodd-Frank Act”) which inadvertently excluded IOLTA accounts from the unlimited FDIC insurance program that extended the Transaction Account Guarantee (TAG) Program put into place in 2008 to help stabilize the banking industry.

The Dodd-Frank Act (signed into law on July 21, 2010) also permanently raises the standard maximum deposit insurance amount to $250,000.

While the TAG Program allowed financial institutions to opt-out, Dodd-Frank does not. Therefore, an IOLTA account held at any FDIC member bank will have unlimited coverage until December 31, 2012.

IOLTA accounts were included under the unlimited insurance provision of the 2008 TAG Program because “… the interest on IOLTAs does not inure to the benefit of either the law firm or the clients. Thus, from the perspective of the law firm and the clients, the account produces the same economic result as a noninterest-bearing transaction account.” (FEDERAL DEPOSIT INSURANCE CORPORATION, 12 CFR Part 370, RIN 3064-AD37, Temporary Liquidity Guarantee Program, p.44)

The New Jersey IOLTA Rule is clear that client funds must be placed at interest to a client or to IOLTA.

Rule 1:28A-2(2) requires that “Funds shall be deposited in an IOLTA non-interest bearing trust account authorized by this Rule when an attorney determines that a trust account deposit will not be placed at interest for a client.” The only exception would be for an account which normally carries a very low balance and that has been registered as such on the annual IOLTA registration form. Note also that sub-accounts must be either interest-bearing to a client OR to IOLTA.

In New Jersey, law firms must maintain an attorney trust account at an approved financial institution. The approval of a bank to offer trust accounts in New Jersey does not imply an endorsement of that bank’s safety and soundness. Approval is given on behalf of the Supreme Court of New Jersey by the Office of Attorney Ethics because a bank agrees to report overdrafts and cooperate with the IOLTA program. It is the law firm’s responsibility to select a bank (or banks) based on financial condition, convenience and other factors.

FDIC coverage for fiduciary accounts is different from ordinary accounts.

In its Frequently Asked Questions section, the FDIC says “Special disclosure rules apply to multi-tiered fiduciary relationships. If an agent pools the deposits of several owners into one account and the disclosure rules are satisfied, the deposits of each owner will be insured as that owner’s deposits.” (Seehttp://www.fdic.gov/deposit/deposits/insured/faq.html).

  • Unlimited FDIC coverage per depositor applies to pooled attorney trust accounts only.

  • Each client’s funds in a pooled IOLTA account are separately insured, as if the client had an account at that bank. Placing separate client deposits in a common trust account dictates keeping meticulous trust account records as required by Court Rule 1:21-6 and the Office of Attorney Ethics.

  • To qualify for FDIC insurance your account must be titled properly as a fiduciary account, for example, Law Office of Thomas Jones, Attorney Trust Account. This is also a requirement of Rule 1:21-6. IOLTA accounts carry the Tax I.D. of the IOLTA Fund. Permission to use our Tax I.D. is given in writing by IOLTA to the bank when a law firm returns an IOLTA Participation form indicating that an account qualifies to be interest-bearing to IOLTA.

  • Ordinary FDIC coverage is applicable to client sub-accounts, up to $250,000 per individual. A husband and wife are each insured separately, up to $500,000, provided your deposit documentation clearly describes the ownership of their funds.

  • A client might have a separate banking relationship at the same institution as the firm’s trust account which would share the FDIC coverage for that single depositor.

  • When a lawyer has a concern that a particular deposit in a sub-account at any bank will exceed insurance coverage limits, the lawyer could consider utilizing a pooled or common trust account OR second trust account in the client’s name at a different financial institution.

  • New trust accounts may be reported to IOLTA at any time. The 2011 IOLTA registration form is available online athttp://www.ioltanj.org/lwr_comp.html.

How are Official Checks Insured?*

Official checks, such as cashier’s checks and money orders issued by banks, are “deposits” as defined under the FDI Act (12 U.S.C. 1813(1)) and Part 330 of the FDIC’s regulations. The payee of the official check (the party to whom the check is payable) is the insured party. If an official check is negotiated to a third party, the FDIC would recognize that person as the insured party, subject to certain requirements. (12 CFR Section 330.5(b)(4).) Because official checks meet the definition of a noninterest-bearing transaction account, the payee (or the party to whom the payee has endorsed the check) would be insured for the full amount of the check upon the failure of the bank that issued the official check.

How are Sweep Accounts Insured?*

Under the FDIC’s rules and procedures for determining account balances at a failed bank (12 CFR Section 360.8), funds swept (or transferred) from a deposit account to either another type of deposit account or a non-deposit account are treated as being in the account to which the funds were transferred prior to the time of failure. So, for example, if pursuant to an agreement between a bank and its customer, funds are swept daily from a noninterest-bearing transaction account to an account or product (such as a repurchase agreement) that is not a noninterest-bearing transaction account, the funds in the resulting account or product would not be eligible for full insurance coverage. This is how sweep account products were treated under the T AG Program.

How are Multiple Accounts Insured?*

Pursuant to Section 343, all funds held in non interest-bearing transaction accounts will be fully insured, without limit. As also specifically provided for in Section 343, this unlimited coverage is separate from, and in addition to, the coverage provided to depositors with respect to other accounts held at bank. This means that funds held in noninterest-bearing transaction accounts will not be counted in determining the amount of deposit insurance on deposits held in other accounts, and in other rights and capacities, at the same bank. Thus, for example, if a depositor has a $225,000 certificate of deposit and a no-interest checking account with a balance of $300,000, both held in a single ownership capacity, he or she would be fully insured for $525,000 (plus interest accrued on the CD), assuming the depositor has no other single ownership funds at the same institution. First, coverage of $225,000 (plus accrued interest) would be provided for the certificate of deposit as a single ownership account (12 CFR 330.6) up to the usual limit of $250,000. Second, full coverage of the $300,000 checking account would be provided separately, despite the checking account also being held as a single ownership account, because the account qualifies for unlimited separate coverage as a noninterest-bearing transaction account.

The plan for Capital Partners Funding Group, Inc., I told you that it paid $30,000. every month.  Correction, it pays that amount once a year for 10 years, all of which has to be used for Kingdom Business.  After the year is up the money that I invested is placed back into my IRA account.

1. Small Cap Specialists: $5,000 to $50,000,000 – two programs: 1. Chris pays 4% to 8% a month before commissions and account fees. 2. Greg gold buy-sell 10% to 15% a month. Greg’s minimum is $50,000. His maximum is $5,000,000. Chris’ program is 23 years old. Greg’s program is about a year old.

 

2. Project Funding: Any size but we need to be paid our 1% minimum $3,000 maximum $30,000 per project  fully earned non-refundable commitment/consultation fee or we pass. I absolutely refuse to work for free. The commission is 2% on most commercial loans in addition to the fee.

 

3. Asset Monetization.

I enjoyed and found informative what you had to say about private placement / private client investments very interesting indeed.  You have most certainly done your homework and have, for your own benefit and for the benefit of your many clients, methodically documented all that has been disclosed to yourself and that which you have acquired in the marketplace over the years.

I’d like to document the following in an attempt to sum up my intentions and the potential way forward which we discussed (please fill in the gaps if there are any):-
  • I’d like to test a program which is successful;
    • The programs which your business associate Chris, located in New Zealand, is appealing for various reasons, namely:-
      • His program has 23 years of success;
      • he has to date never lost a clients principal amount;
      • He concluded contracts will all clients and has always paid in terms of the contracts concluded;
      • The contracts concluded are between the trader (Chris) and the principal (myself);
      • Chris is a retired US Treasury Agent;
      • Chris has a contract with the bank;
      • Chris typically operates a ‘buy/sell’ program I.e. He has a profitable transaction lined up before committing funds to a transaction (by way of example, as a real estate investor I may have a purchaser for a condo at a price of USD100 and I know of someone wishing to sell a condo which fits the purchasers profile at a price of USD95 –  only once I have both qualifying parties lined up do I close on the transaction as I know up-front that a USD 5 or 5% profit margin be made);
      • Whilst there are no guarantees in any program he has paid 4%-8% per month gross, before commission of 10% being deducted;
      • Chris had various programs with differing financial entry levels, ‘lock-in’ periods and anticipated returns;
      • Chris discussed and agrees to contracts with individual clients;
      • Individual banking accounts are established for the ‘principal amount’ and ‘trading account returns’ thereby providing investors/clients such as myself with constant online access to both accounts – both of which are in our names and under our control.

  • We discussed ‘risk and reward’ together with risk tolerance, generally.  Forex returns are great but so are the losses I.e. For every gain someone in the chain has made a loss;
    • Forex only really works for those who require less volatility if ‘stop losses’ are in place;
    • Forex markets are volatile and have high degrees of risk – it is really the same as gambling as one does not know which way the market would go;

  • After proving success over a period of time (6 months is a minimum period to experience success of a program and protecting of principal amount) I wish to establish my own Fund, in joint venture or otherwise, with the Fund manager who has achieved the success.  Essentially, my partner/s and I would be the majority shareholders and also directors of the new Fund;
  • I would ‘profile’ and ‘position’ the opportunity to a select public and private sector entities in terms of diversification of investment spread.  Investments would then be brought in from a client base that we would introduce to the fund;
  • You were to facilitate communication between yourself, Chris and myself to get the wheels in motion for a first transaction to test the success of the program.  I look forward to this being facilitated by yourself either via an email to myself and copied to Chris or any other means you may be comfortable with.
